Subject
These General Terms and Conditions of Sale (hereinafter, “General Conditions”) govern the purchase of Products made remotely via telematic networks through the website www.moodme.store (hereinafter, the “Site”).
Seller
The owner of the Site is Pidielle S.p.A., with registered office at Bergamina 7 – 20014 Nerviano, telephone +39 0331 580166, email mood@moodme.store, VAT no. IT 03001250962, R.E.A. MI-1620143.
Acceptance of the General Terms and Conditions of Sale
- All purchases of Products made through the Site by users who access it (hereinafter, the “Customers”) are governed by these General Conditions, as well as by the Italian Consumer Code (Legislative Decree no. 206/2005) and Italian regulations on electronic commerce (Legislative Decree no. 70/2003).
- By completing the Purchase Contracts according to the prescribed procedure, the Customer accepts and agrees to comply with these General Conditions.
- The Customer is therefore required to carefully read these General Conditions before carrying out any purchase transaction. Pidielle S.p.A. makes them available also to allow the Customer to reproduce and store them in accordance with Article 12, paragraph 3 of Legislative Decree no. 70/2003.
- Pidielle S.p.A. may modify the content of the General Conditions at any time and without prior notice. The General Conditions published on the Site at the time the Customer submits the purchase order shall apply to each individual Purchase Contract. The Customer may save a copy of them in PDF format or keep the order confirmation email, to which the conditions are attached.
Products
- www.moodme.store (hereinafter, the “Site”) is an e-commerce website for cosmetics, beauty products for hair care, and related accessories, exclusively under the MOOD brand (hereinafter, the “Products”).
- All Products offered are described in detail on the Site within their respective sections and are categorized by product type in compliance with the provisions of the Italian Consumer Code.
- The visual representation of the Products on the Site, where available, is for illustrative purposes only and generally corresponds to photographic images of the Products. Its purpose is to present them for sale without any guarantee or commitment by Pidielle S.p.A. regarding the exact correspondence between the image shown on the Site and the actual Product. This applies in particular to the actual dimensions and/or the color aspects of the Products and/or their packaging.
- In the event of any discrepancy between the image and the written product description, the product description shall always prevail.
- Customers are not permitted to sell or resell the Products purchased. Pidielle S.p.A. may suspend, revoke, or limit supply if it deems, at its sole discretion, that the Customer may be in breach of this provision.
Purchase Procedure
- The Customer may purchase the Products listed in the MOOD electronic catalogue, which are described in detail on the Site within their respective product categories, as outlined in the relevant information sheets available on the Site, by following the technical access procedures indicated therein.
- Before proceeding, the Customer may register on the Site by entering their personal details and following the instructions provided in the registration process. The Customer must then complete and submit to Pidielle S.p.A. the order form in electronic format available on the Site, following the instructions provided. Purchase orders must be completed accurately in all their parts. If the Customer chooses not to register on the Site, they may still complete the purchase process; however, they will not be able to track the status of their orders or take advantage of discounts and promotions.
- The Customer must place the selected Products into the appropriate “Cart” and, after selecting the shipping options and accepting the contribution for delivery costs, may proceed with the purchase.
- If the Customer needs to modify the purchase order or any of the data contained therein, they must follow the specific modification procedure available on the Site. In particular, the Customer has the option to change the quantity of Products they intend to purchase, adding or removing one or more Products from the Cart.
- Once this process is completed, the Customer will be shown a summary screen of the purchase order, including delivery costs, and will be asked to confirm the purchase procedure once again.
- After viewing the summary, the Customer must select the desired payment method—PayPal, Shopify Payments, bank transfer, cash on delivery, or, where available, Gift Card—and submit the order by clicking the appropriate button.
Conclusion of the Contract
- The publication of the Products displayed on the Site constitutes an invitation to the Customer to submit a contractual purchase offer. The order sent by the Customer has the value of a contractual proposal and implies full knowledge and complete acceptance of these General Conditions.
- Each Purchase Contract entered into between Pidielle S.p.A. and the Customer shall be deemed concluded when Pidielle S.p.A. sends acceptance of the order to the Customer’s email address. This confirmation message will include an “Order Number,” to be used in all subsequent communications with Pidielle S.p.A. In addition to the information required by law, the message will contain all the data entered by the Customer, who undertakes to verify its accuracy and promptly communicate any corrections. Any additional costs resulting from errors in the data that are not promptly reported shall be borne exclusively by the Customer.
- Each order may be viewed by the Customer on the Site in their personal area, if registered, or by contacting Pidielle S.p.A. Customer Service immediately after submitting the order.
- Products offered may occasionally be unavailable. In such cases, if the Products selected by the Customer are not available in whole or in part, Customer Service will contact the Customer via email. The Customer may then choose to cancel the order, wait until the Product(s) become available again, or receive only the available Products. In the latter case, the order will be partially fulfilled, and Pidielle S.p.A. undertakes to ship the missing Products at its own care and expense.
- Pidielle S.p.A. reserves the right not to accept purchase proposals and to cancel orders that do not provide sufficient guarantees of solvency. This may occur, for example, if—following checks with the payment processing network handling credit card transactions—anomalies are detected in the transactions or payment methods used by the Customer. In such cases, the Customer will be promptly notified by email.
Product Prices
All Product prices are clearly indicated on the Site in accordance with Articles 13 et seq. of the Italian Consumer Code and are inclusive of VAT. Delivery costs are clearly shown at the time of the order. The cost of each shipment may vary depending on the chosen delivery and payment methods, as well as the destination and the total amount of the order.
Billing and Payment Methods
- Pidielle S.p.A. issues a receipt, or an invoice if requested, for the Products purchased at the moment the Products are handed over to the courier for shipment, sending it via email to the Customer. The information provided by the Customer shall be considered accurate for the issuance of the invoice. No changes to the data will be possible after the invoice has been issued.
- As further detailed below, payments made via PayPal require only an authorization or a reservation of funds, without actual charging, at the time the Customer places the order. The payment is therefore actually charged to the Customer only when the Products are delivered to the designated courier for shipment. At this stage, Pidielle S.p.A. will also issue the invoice related to the order.
- Payment for the Products purchased can be made via PayPal, Shopify Payments, bank transfer, or—if available—Gift Card, according to the procedures specified below:
Bank Transfer
Once the order has been completed and the Customer has chosen bank transfer as the payment method, the Customer must make the payment using the following bank details and specifications:

After completing the payment via bank transfer, the Customer must send a copy of the payment confirmation to the following email addresses: amministrazione@elgoncosmetic.it and mood@moodme.store.
The order will be processed according to the timing of receipt of the funds.
PayPal
Once the order is completed and PayPal is selected as the payment method, the Customer will be redirected to the PayPal website, where they can log in to their account using their personal email address and password. By choosing to pay with PayPal, the amount will be charged directly to the linked credit card (Visa, Visa Electron, Mastercard, American Express) or prepaid card (PostePay).
PayPal protects the Customer’s information, as no financial details are shared with the merchant. For each transaction made using this method, a confirmation email will be sent by PayPal.
Please note that the order amount is charged to the PayPal account only when the order is taken in charge by the courier. At the time of placing the order on the website, only an authorization request is made to verify the availability of funds in the Customer’s PayPal account, with no actual charge. In case of order cancellation, the amount will be refunded to the Customer’s PayPal account.
Gift Card
The Customer may use a “Gift Card” for payment by selecting Gift Card as the payment method in the Cart and, after choosing the shipping method, entering the number located under the barcode along with the security code.
Shopify Payments
If payment is made by credit card, the Customer will be redirected to a secure website, and the credit card information will be transmitted directly to Shopify Payments, the operator handling payments on behalf of the Seller. The data is sent in a secure manner via encrypted transfer using SSL (Secure Socket Layer) 128-bit encryption. This information is not accessible even to the Seller.
Pidielle S.p.A. is not responsible for delays and/or failure in delivery of the Products if the issuer of the credit card used by the Customer refuses or does not authorize the charge.
Delivery Methods and Costs
- Pidielle S.p.A. undertakes to deliver the goods without undue delay and, in any case, no later than thirty days from the conclusion of the contract. Delivery of the Products will be carried out via courier, and delivery times may vary depending on the destination. The estimated times indicated at the moment of the purchase order are for guidance only.
- Pidielle S.p.A. delivers exclusively within Italy, and delivery will be made via courier without a scheduled appointment.
- The Customer cannot hold Pidielle S.p.A. liable, under any circumstances, for delays in order processing or delivery of the Products covered by the Purchase Contracts.
- Products ordered will be shipped to the postal address specified by the Customer. Deliveries are carried out from Monday to Friday during regular business hours, excluding national holidays, according to the courier’s procedures. Delivery is considered completed when the Product is made available to the Customer at the address specified in the order form.
- In the event of a failed delivery due to the recipient’s absence, the courier will leave a notice and attempt a second delivery according to its procedures. If the second delivery cannot be completed due to the recipient’s absence, the courier’s Customer Service will attempt to contact the Customer to schedule an additional delivery. If the Customer cannot be reached within 10 days, or if delivery remains impossible due to the recipient’s absence, the Products will be returned to Pidielle S.p.A., and the Customer may request a refund for the total order.
- Upon delivery of the Products by the courier appointed by Pidielle S.p.A., the Customer is required to carefully check:
a) That the packaging is intact and not damaged or otherwise altered.
b) That the number of items delivered matches the details in the shipping document. - Any damage to the packaging or Products, or discrepancies in the number of items/packages, must be immediately reported by the Customer, who may contact Pidielle S.p.A. via Customer Service at mood@moodme.store, specifying the order affected.
- Force majeure events, unavailability of transportation, or other unforeseeable or unavoidable events that cause delivery delays, make delivery difficult or impossible, or significantly increase delivery costs for Pidielle S.p.A., entitle the company to split, postpone, or cancel delivery in whole or in part, or to terminate the Purchase Contract. In such cases, Pidielle S.p.A. will provide prompt and adequate notice of its decisions to the email address provided by the Customer, who will be entitled to a refund of any amount already paid, excluding any further claims of any kind against Pidielle S.p.A.
Discount Vouchers – Promotions
Any discount vouchers or promotional codes may be entered by the Customer when completing the purchase order. The system will automatically update the total order amount, deducting the value of the voucher.
The discount voucher may be combined with other commercial promotions only in cases where this is explicitly indicated.
Right of Withdrawal
If the Customer is not satisfied with the Product, or if Products delivered do not conform to the order, the Customer has the right to withdraw from the contract without giving any reason within 14 days from the receipt of the Products.
The right of withdrawal can only be exercised by the person who made the purchase (the invoice holder) and not by other individuals who may have received the delivery.
The return of Products is subject to acceptance by Pidielle S.p.A. in Parabiago. To initiate a return, the Customer must contact our Customer Service at mood@moodme.store, providing the following information:

- Order Reference Number
The Customer must then send the Product to Pidielle S.p.A.

Returns of items purchased will not be accepted if the above procedure has not been followed. It is recommended to send the package containing the returned Products via registered mail with return receipt.
Conditions for Acceptance of Returns:
To accept a return, Pidielle S.p.A. must verify that the Product has not been used and has not suffered any damage. Returned Products must be shipped within 14 days from the delivery date in their original packaging or, if damaged, in packaging of equivalent size and strength. Refunds will only be issued if all these conditions are met. Shipping and handling costs are non-refundable.
Return Shipping Costs:
If the Customer exercises the right of withdrawal, the shipping costs for returning the Product are borne by the Customer. Similarly, if a Product is returned for final withdrawal, replacement, or exchange due to non-compliance with the order or intrinsic defects (only for unused Products), the return shipping costs are the responsibility of the Customer. Once Pidielle S.p.A. has verified the nature of the return and accepted the claim, the return shipping costs for defective or damaged Products will be borne by Pidielle S.p.A.
Refund Credit
Once we have received the returned Product and verified that all conditions have been met, we will send a confirmation email to the Customer and proceed to credit the amount paid back to the credit card used by the Customer to pay for the Products. For credit card purchases, the time required to see the refund will depend on the Customer’s banking institution. The value date of the refund will, in any case, correspond to the original charge date.
Non-Conformity and Defective Products
- The Products offered on the Site comply with national and EU legislation. Images and colors of the Products displayed on the Site may differ from the actual Products due to local system settings and/or the devices used for viewing.
- In the event of a defect or non-conformity of the Products purchased relative to the description on the Site, or in the case of a faulty or defective Product, the Customer is entitled to an immediate refund of the non-conforming Product, provided that photographs showing the damage or non-conformity are sent by email to mood@moodme.store.
- Pidielle S.p.A. staff will then communicate the refund procedure, which, at the Customer’s discretion, may also be issued in the form of discount vouchers for future purchases, of a value equal to or greater than the refunded Product, excluding any further liability of Pidielle S.p.A. of any kind.
- These provisions are without prejudice to the statutory rights regarding the legal guarantee of conformity of goods under the Italian Consumer Code (Legislative Decree 206/2005, Part IV, Articles 102–135).
Communications and Complaints
All communications or complaints from the Customer regarding the Purchase Contracts must be sent exclusively by email to mood@moodme.store.
Intellectual Property Rights
- All trademarks (registered or not), as well as any work of authorship, distinctive sign or name, image, photograph, written or graphic text, and, more generally, any other intangible asset protected by national and international intellectual and industrial property laws and conventions, reproduced on the Site remain the exclusive property of Pidielle S.p.A. and/or its assigns. Access to the Site and/or the conclusion of Purchase Contracts does not grant the Customer any rights over such assets. Any use, even partial, of these assets is prohibited without the prior written authorization of Pidielle S.p.A., which retains all related rights exclusively.
Governing Law and Jurisdiction
- These General Conditions and any contract concluded with the Customer are governed by Italian law, without prejudice to the application of EU regulations and international treaties, where applicable, as well as national legislation protecting consumers.
